Dolphin Bycatches in Tuna Fisheries: A Smokescreen Hiding the Real Issues
The taking of dolphins in Tuna Fisheries has attracted a lot of attention in both law and science. The problem assumed international significance in the wake of the two General Agreement on Tariffs and Trade (GATT) panels on imports of tunas. This article addresses the issue of incidental bycatch in fisheries generally and avers that dolphins are but one of the numerous species that are taken incidentally in commercial fisheries. It argues that the bycatch problem should be approached from a broader perspective that takes into account whole ecosystems and diverse interests in fisheries. It then posits possible ways of encouraging more selective fishing techniques that minimize overall bycatches.

Definition of an Environmental Right in a Human Rights Context
This article examines the theoretical background of a right to environment, its contents and the different ways to achieve implementation of the norm. Environmental protection is first ascertained as a universal concern which warrants consideration within a human rights context. Innovative features of the right such as the emphasis on prevention and on the principle of solidarity deriving from the internationalization of environmental problems are then examined. Further, some implementation mechanisms such as procedural rights developed at the same time in environmental and human rights instruments or the judicial appraisal of environmental protection in the context of enforceable human rights are highlighted.

Water Law, Poverty, and Development - Water Sector Reforms in India
This monograph comprehensively examines water law regulations and reform in the present decade, going beyond a simple analysis of existing water law and regulations to encompass environmental, social, economic, and human rights aspects of water as a natural resource. Using the specific case of India and on the related international law and policy framework that directly influences water regulatory developments in India, this book offers what will be the first and only analysis of water law reforms taking place at the national level in many developing countries in their domestic and international context. On the one hand, international freshwater law remains under-developed and existing legal instruments such as the 1997 UN Convention only address a limited set of relevant issues. Yet, the international law and policy framework concerning freshwater is increasingly important in shaping up law reforms taking place at the national level, in particular in developing countries. Indeed, non-binding resolutions such as the Dublin Statement on Water and Sustainable Development (1992) have had an immense influence on water law reforms in most developing countries.
This book seeks to conceive of and analyse freshwater regulation in a broader context, and go beyond a literature that either lauds or criticises ongoing water sector reforms to provide an analytical basis for the reforms which all countries will have to adopt in the near or medium-term future.

Evolution of Water Law and Policy in India
This chapter examines the evolution of water law and policy in India from pre-historic to present times, briefly outlining pre-colonial developments and focusing on colonial and postcolonial issues and the complexity of regulating water in India. The fragmentation of water law in the past has not yet been overcome. Water law remains patchy partly because it is a state subject while being also an issue of concern at the union level and partly because there are elements of water law in environment or health laws. Further, division of tasks between various social actors and levels is unclear. Water policy is being pushed in a number of different directions, reflecting the specificities of the Indian situation, such as its complex administrative structure, overlapping and sometimes contradictory rights frameworks, vastly different endowments in water resources in different regions, and difficulties in allocating water in the most socially and economically appropriate manner.

Water Law for the Twenty-First Century - National and International Aspects of Water Law Reform in India
In the face of growing freshwater scarcity, most countries of the world are taking steps to conserve their water and foster its sustainable use. Water crises range from concerns of drinking water availability and/or quality, the degradation or contamination of freshwater, and the allocation of water to different users. To meet the challenge, many countries are undergoing systemic changes to the use of freshwater and the provision of water services, thereby leading to greater commercialization of the resource as well as a restructuring of the legal, regulatory, technical and institutional frameworks for water.
The contributions to this book critically analyse legal issues arising under international law, such as environment and human rights provisions, concerning the economic, environmental and social consequences of proposed water regulatory changes and their implementation at the national level. The book examines the situation in India which is currently in the midst of implementing several World Bank led water restructuring projects which will have significant impacts on the realisation of the right to water and all other aspects of water regulation for decades to come. In analysing the situation in India the volume is able to detail the interactions between international law and national law in the field of water, and to ask broader questions about the compliance with international law at the national level and the relevance of international law in national law and policy making.

While courts have long engaged with water law, activities in recent years have been particularly important because of the introduction of water sector reforms and water law reforms that seek to reshape the water sector. The response of courts to these devel- opments is particularly important. However, there has been no unified response to ongoing changes as Indian courts have given varying responses to the variety of cases submitted to them.

The fundamental right to water in rural areas is well-established in India, but the actual content of this right has not been elaborated upon in judicial decisions. There is no general drinking water legislation that would provide this missing content. This analysis of various initiatives taken by the government for rural drinking water supply finds that these initiatives do not amount to a comprehensive binding legal framework covering all the main aspects of the fundamental right to water.

Water Law in a Globalised World – Need for a New Conceptual Framework
Water law is at a crossroads. Its basic structure and principles are being challenged by the increasingly global dimension of water issues. Yet, neither the international framework nor national water laws acknowledge the intrinsic links between the global water cycle and access to water at the local level. Water law must be reconceived around a broader understanding of water while being allowed at the same time to shed its old sectoral framework that makes little space for integration with other related areas of law such as environmental and human rights law.

Water Law in India – An Introduction to Legal Instruments
India’s dependence on water is critical owing to its large agricultural base, the water needs of its billion-plus population, and the recent economic growth trends. Despite the plethora of material on environmental law, legal scholarship on water law in particular has been negligible. This timely work pieces together key legislative instruments and policy documents to provide an overarching picture of the legal regime and regulations related to water in India. The book discusses the policy framework for the use of water in India. It also brings out the complexity in the structure of laws due to variations at the levels of their implementation, i.e., at the international, national, state, municipal, and panchayat levels. Fairness in Adaptation to Climate Change
As a global society, we need to take action not only to prevent the potentially catastrophic effects of climate change but also to adapt to the unavoidable effects of climate change already imposed on the world. Fairness in Adaptation to Climate Change looks at the challenges of ensuring that policy responses to climate change do not place undue and unfair burdens on already vulnerable populations. All countries will be endangered by climate change risks from flood, drought, and other extreme weather events, but developing countries are more dependent on climate-sensitive livelihoods such as farming and fishing and hence are more vulnerable. Despite this, the concerns of developing countries are marginalized in climate policy decisions that exacerbate current vulnerabilities. Fairness in Adaptation to Climate Change brings together scholars from political science, economics, law, human geography, and climate science to offer the first assessment of the social justice issues in adaptation to climate change. The book outlines the philosophical underpinnings of different types of justice in relation to climate change, present inequities, and future burdens, and it applies these to real world examples of climate change adaptation in Bangladesh, Tanzania, Botswana, Namibia, and Hungary. It argues that the key to adapting to climate change lies in recognizing the equity and justice issues inherent in its causes and in human responses to it.

Carbon reporting: does it matter?
This paper identifies the significance of carbon emissions reporting for investment bankers at selected financial institutions in the USA, Europe and Australia. Carbon emissions reporting methods as used by firms are identified using desk research. A proposal from a non-state actor called the Climate Disclosure Standards Board for general-purpose carbon emissions reporting is assessed. We find that environmental investing for well-diversified investors constitutes a discourse of the imaginary. Financialised constructs have been used to represent heavier polluters as superior ‘carbon performers’ (the imaginary), while reported variations in industrial carbon emissions levels have been ignored in asset allocation decisions (the actual).
Environmental investing is conditioned by four factors:
- exclusion of carbon emissions in constructions of firm value;
- diverse methods used by firms to calculate, measure and report carbon emissions;
- the appropriate venue for such reporting; and
- the quantum of data contained therein.
Risk assessment is likely to be erroneous if using measures which deflate carbon emissions by firms’ revenues. This may not matter much as carbon reports in the hands of investors are linked to an imaginary signification more so than actual portfolio allocation.

Is Water Policy the New Water Law? – Rethinking the Place of Law in Water Sector Reforms
Water law and policy are in principle clearly distinct at the national and international levels. The
former is binding while the latter is not. Yet, over the past two decades, the respective space of water law
and water policy has evolved to the point where the distinction between the two is sometimes sidelined.
At the international level, the increasing pre-eminence of water policy is due in part to the absence of
binding legal frameworks in various key areas of the water sector. This has led international water
governance to be significantly different from other sectors. At the national level, reforms in the water
sector over the past 20 years have often been heavily influenced by the non-binding international water
policy instruments. This article explores the trajectory of water law and water policy at the international
level and in India over the past two decades. It highlights the specificities of the water sector in this regard
and some of the problems that arise when policy ends up either replacing law or as a framework
superseding law, thereby throwing out of gear most of the basic principles around which democratic legal
orders are based.

International climate change law and policy : cultural legitimacy in adaptation and mitigation
Climate change poses fundamental and varied challenges to all communities across the globe. The adaptation and mitigation strategies proposed by governments and non-governmental organisations (NGOs) are likely to require radical and fundamental shifts in socio-political structures, technological and economic systems, organisational forms, and modes of regulation. The sheer volume of law and policy emanating from the international level makes it uncertain which type of regulatory or policy framework is likely to have a positive impact. The success or failure of proposed measures will depend on their acceptability within the local constituencies within which they are sought to be applied. Therefore there is an urgent need to better comprehend and theorise the role of cultural legitimacy in the choice and effectiveness of international legal and policy interventions aimed at tackling the impact of climate change.
The book brings together papers from experts on the subject who participated at an international interdisciplinary conference at the University Surrey and presents perspectives from different disciplines on the issue of international climate change law and policy. Beginning from the premise that legitimacy critiques of international climate change regulation have the capacity to positively influence policy trends and legal choices, the book showcases innovative ideas from across the disciplines and investigate the link between the efficacy of international legal and policy mechanisms on climate change and cultural legitimacy.

Do environmental policy instruments influence fiduciaries’ decisions?
This article examines the import of companies’ environmental performance levels in light of existing and nascent energy-usage and environmental management policies. The study is based on an experiment using a sample of financial institutions located in Europe, North America and Australia. One of several contributions of this article is its framing and consolidating of literature on energy and environmental management policy, environmental investing, and decision psychology.

Groundwater is now the main source of water for all major water uses in India and needs to be given greater policy attention. The fact that it is a politically sensitive topic because any reform will affect some powerful constituencies cannot be an excuse anymore for lack of action. Inaction only increases existing inequalities in access to groundwater by progressively reinforcing the power of bigger landowners at the expense of other water users. This article examines the basic principles governing access to and use of groundwater inherited from the past to the Model Bill for the Conservation, Protection and Regulation of Groundwater, 2011, which provides a basis for rethinking groundwater regulation.

Right to Water in India – Plugging Conceptual and Practical Gaps
This article examines the content of the human right to water. It starts from the premise that the right is firmly anchored in international and national law. It thus moves beyond debates concerning either the existence or the legal status of the right in favour of a more in-depth discussion of its content. It focuses on India, a country where the right is well entrenched at a broad level but where the actual content of the right is not well defined in legal instruments. It considers some of the aspects of the right that are most critical at this juncture from a policy perspective, including the need to ensure that the universality of the right in theory is matched by universal realisation, the need for the core content of the right to be provided by the state and the need to recognise the right as including a free water component if it is to make a difference for the overwhelming majority of poor people.

Governing the Environment without CoPs – The Case of Water
CoPs have played a key role in governing the environment. Yet, CoPs have only provided the institutional framework for governing issues falling under existing treaty regimes. They have not been able to go beyond the regimes they govern. In the case of water, the absence of a well-developed treaty regime has open the door to new non-governmental institutions taking the lead. This happens to coincide in part with the framework proposed by global administrative law that sees governance as a set of largely non-hierarchical relationships where states are not necessarily dominant. This article critically analyse the contribution that global administrative law makes to our understanding of environmental stewardship and looks at ongoing institutional reforms in the water sector that are not based on CoPs being the main actor.

Groundwater Law in India – Towards a Framework Ensuring Equitable Access and Aquifer Protection
Groundwater law in India gives individual landowners overwhelming control over groundwater. This is inappropriate in a context where groundwater is now the main source of water for the realisation of the human right to water. This also fails to provides the basis for effective protection of groundwater at aquifer level. Increasing dependence on groundwater for all the main water uses has made the need for reforms of the legal framework increasingly acute. This article argues that groundwater law must be reconceived around a new set of principles that recognise the common nature of groundwater, its importance in realising the human right to water, the need for a governance framework starting at the local level and the need for a strong aquifer protection regime. The proposed new framework is then examined in the context of the Groundwater Model Bill, 2011 that reflects in large part this new framework.
