This article discusses the limitations of the law incorporating a corporation (‘incorporation law’) as a control or governance mechanism in a world where it is increasingly difficult to prevent corporations choosing the incorporation law which suits them best. It uses as an example of the globalising pressures in this field three important cases on the right of establishment in the European Union.

This volume brings together the practical insights and experiences of individuals and organisations working in diverse regions and contexts to combat 'crimes of honour'. Authors examine strategies of response to such manifestations of violence against women, focusing largely on 'honour killings' and interference with the right to choice in marriage, and the related use and legal treatment of the defence of 'honour' and 'provocation' in different countries of Europe, the Middle East, Latin America and South Asia. This timely volume is distinctive in approach and content, highlighting activist and practice-orientated academic perspectives from both the South and the North. The authors give voice to the struggle to locate 'crimes of honour' firmly within the international framework of violence against women and human rights, rather than positioning these abuses as specific to particular cultures or communities. This book combines an examination of women's rights in Muslim family law in Arab states from the Gulf to North Africa with discussions of the public debates surrounding the issues that are raised in processes of codification and amenement. This study considers new laws along with older statutes to comment on patterns and dynamics of change both in the texts of the laws and in the processes by which they are drafted and issued. It draws on original legal texts as well as on extensive secondary literature for an insight into practice; interventions by women's rights organisations and other parties are drawn on to identify areas of the laws that remain contested. The discussions are set in the contemporary global context that internationalises the domestic and regional discussions.

The Role of Islam in the Legal System of Pakistan

The role of the judiciary in the Islamisation of Pakistan’s legal system has not received much attention by legal scholars. This book aims to fill this gap. Starting in 1947, it examines the way Pakistani judges have dealt with the controversial issue of Islam in the past 50 years. The book’s focus on reported case-law offers a new perspective on the Islamisation of Pakistan’s legal system in which Islam emerges as more than just a challenge to Western conceptions of human rights. The first part examines the emergence of Islamic arguments in the period up to 1977 when General Zia ul Haq embarked on an ambitious project to turn Pakistan into a truly Islamic state. In these early years of Pakistan judges increasingly turned to Islam as a source of law to preserve judicial independence and to protect the country’s faltering democracy. The second part examines in detail the features and effects of Zia’s Islamisation programme especially the workings of the newly created Federal Shariat Court. The third part reviews the legal developments in the post-Zia period when the judicial gates of Islamization which were first wide opened, have gradually been closed by a series of landmark decisions. What emerges from this analysis is an image of Islam as a source of law which is rich, complex and varied. Depending on the judge and the court, Islam was applied to varying effects ranging from liberal to extremely conservative attitudes. However, they share a common feature, namely that the role of Islam in the legal system of Pakistan is to a large degree determined by its higher judiciary.

International Human Rights and Islamic Law

This book explores whether or not international human rights and Islamic law are compatible. It asks whether Muslim States can comply with international human rights law whilst adhering to Islamic law. The traditional arguments on this subject are examined and responded to from both international human rights and Islamic legal perspectives. The volume engages international human rights law in theoretical dialogue with Islamic law, facilitating an evaluation of the human rights policy of modern Muslim States. It formulates a synthesis between these two extremes, and argues that although there are differences of scope and application, there is no fundamental incompatibility between these two bodies of law. The author argues that their differences could be better addressed if the concept of human rights were positively established from within the themes of Islamic law, rather than by imposing it upon Islamic law as an alien concept. Each article of the International Covenant on Civil and Political Rights, and the International Covenant on Economic, Social and Cultural Rights, as well as relevant articles of the Convention on the Elimination of All Forms of Discrimination against Women, are analysed in the light of Islamic law. The book concludes that it is possible to harmonise the differences between international human rights law and Islamic law through the adoption of the ‘margin of appreciation’ doctrine by international human rights treaty bodies and the utilization of the Islamic law doctrines of ‘maqâsid al-sharî'ah’ (the overall objective of Sharî'ah) and ‘maslahah’ (welfare) by Muslim States in their interpretation and application of Islamic law, respectively.

Islam and the Realization of Human Rights in the Muslim World: A Reflection on Two Essential Approaches and Two Divergent Perspectives

This article argues that while Islam may not be the sole factor for ensuring the realization of human rights in Muslim States, it is certainly a significant factor that can be constructively employed as a vehicle for improving the poor human rights situation in predominantly Muslim States that recognise Islam as State religion or apply Islamic law or Islamic principles as part of State law. It addresses the question of how best to realize that in light of the two essential approaches (the `socio-cultural approach' and the `politico-legal approach') for promoting and protecting human rights generally, and the two divergent perspectives (the `adversarial perspective' and the `harmonistic perspective') to the discourse on Islam and human rights. The article then advances the view that the harmonistic perspective would be most helpful for employing Islam as a vehicle for the realization of human rights in the Muslim world within the context of the socio-cultural and politico-legal approaches for promoting and protecting human rights generally. Relevant academic and policy oriented examples, especially in relation to promoting women's rights in the Muslim world, are cited to substantiate this position.

Establishing Areas of Common Ground between Islamic Law and International Human Rights

This article re-visits the debate about whether or not Islamic law and international human rights are compatible. It examines and responds to the traditional arguments on the subject from both an international human rights and Islamic legal perspective. It formulates a synthesis between two extremes and argues that although there are some differences, that does not create a general state of dissonance between Islamic law and international human rights. The author argues that the differences would be easier to address if the concept of human rights is first positively established from within the themes of Islamic law rather than imposing it as a concept alien to Islamic law. He thus researches into the sources, jurisprudence and general principles of Islamic law to establish the concept of human rights in common perspective with the concept under international human rights law. The article concludes that through this establishment of common grounds Islamic law could serve as an important vehicle for the realisation of international human rights in the Muslim world.

Islamic Finance Law as an Emergent Legal System

The recent growth in Islamic finance has drawn attention to the alleged “uncertainty” of the sharia, highlighted in 2004 by the Beximco case. On the institutional level, various organisations are addressing the issue; there are also “organic” tendencies towards standardisation. These phenomena are combining with others to form a new legal system, albeit one with particular characteristics. This system has matured sufficiently to merit categorisation as a separate field of study and practice: Islamic Finance Law.

The relationship between modern international law and Islamic law has raised many theoretical and practical questions that cannot be ignored in the contemporary study and understanding of both international law and Islamic law. The significance and relevance of this relationship in both academic and practical terms, especially after the terrorist attacks of 11 September 2001, is now well understood. The Bedouin Judge, the Mufti, and the Chief Islamic Justice: Competing Legal Regimes in the Occupied Palestinian Territories

This article examines competing legal frameworks in dispute resolutionin the occupied territories, against the background of weakening central authority, bitter political rivalries, and increasing insecurity on the ground. Two case studies from 2005 are presented — a killing in Gaza and an attempted sexual assault in the West Bank — where the involved parties had recourse to three distinct but overlapping bodies of law, not all of which were part of the formal Palestinian legal system: statutory law, Islamic law, and customary (or tribal) law. The resolution of these cases, while shedding light on the intersection of local politics and alternative legal systems, underscores the challenges of forging a united legal system in a situation of occupation, weak government, and heterogeneous legal heritage.
